Welcome to Active Coach
These Terms and Conditions ("Terms") govern your use of Active Coach' charter bus services. By booking or using our services, you agree to be bound by these Terms. Please read them carefully.
1. Booking and Reservations
1.1 Reservation Process: All bookings must be made through our website, phone, or email. A reservation is confirmed only upon receipt of a deposit and written confirmation from Active Coach.
1.2 Deposit Requirements: A deposit of 25% of the total rental cost is required to secure your reservation. The remaining balance must be paid 7 days prior to the scheduled service date.
1.3 Payment Methods: We accept credit cards, debit cards, bank transfers, and certified checks. All payments must be in Canadian Dollars (CAD).
1.4 Pricing: All quoted prices are subject to applicable taxes and fees. Prices may vary based on distance, duration, season, and specific requirements.
2. Cancellation and Refund Policy
2.1 Cancellation by Customer:
- More than 30 days before service: Full refund minus 10% administrative fee
- 15-30 days before service: 50% refund of total cost
- 7-14 days before service: 25% refund of total cost
- Less than 7 days before service: No refund
2.2 Cancellation by Active Coach: In the unlikely event that we must cancel your service, you will receive a full refund or the option to reschedule at no additional cost.
2.3 Weather-Related Cancellations: In cases of severe weather or unsafe road conditions, we reserve the right to cancel or postpone service. Alternative dates will be offered, or a full refund will be provided.
3. Service Terms
3.1 Service Hours: Standard service hours are based on the agreed itinerary. Additional hours beyond the contracted time will be charged at the hourly overtime rate.
3.2 Route Changes: Any changes to the agreed route or itinerary must be approved by Active Coach and may result in additional charges.
3.3 Passenger Capacity: The maximum passenger capacity must not be exceeded for safety and legal compliance. Seating is based on the vehicle's certified capacity.
3.4 Delays: While we strive for punctuality, Active Coach is not responsible for delays caused by traffic, weather, road conditions, or other circumstances beyond our control.
4. Passenger Responsibilities
4.1 Conduct: Passengers must behave respectfully and follow all instructions from the driver. Active Coach reserves the right to refuse service to anyone who is disruptive, intoxicated, or poses a safety risk.
4.2 Prohibited Items: Smoking, illegal drugs, weapons, and hazardous materials are strictly prohibited on all vehicles.
4.3 Alcohol: Alcohol consumption is permitted only with prior written approval and for passengers of legal drinking age. The customer is responsible for ensuring compliance with all liquor laws.
4.4 Damage: Customers are responsible for any damage to the vehicle caused by passengers. Cleaning fees may apply for excessive mess or damage.
4.5 Lost Items: Active Coach is not responsible for lost, stolen, or damaged personal belongings. Items found will be held for 30 days.
5. Safety and Compliance
5.1 Safety Standards: All vehicles are maintained to the highest safety standards and comply with all federal and provincial regulations.
5.2 Driver Authority: The driver has final authority on all safety matters. Passengers must comply with all driver instructions and safety regulations.
5.3 Seatbelts: Where equipped, seatbelts must be worn at all times while the vehicle is in motion.
5.4 Emergency Procedures: Passengers must familiarize themselves with emergency exits and procedures as explained by the driver.
6. Liability and Insurance
6.1 Insurance Coverage: Active Coach maintains comprehensive commercial insurance as required by law.
6.2 Limitation of Liability: Active Coach' liability is limited to the amount paid for the service. We are not liable for indirect, incidental, or consequential damages.
6.3 Personal Injury: In the event of personal injury, our liability is limited to the coverage provided by our insurance policy.
6.4 Third-Party Claims: Customers agree to indemnify Active Coach against any third-party claims arising from passenger conduct or actions.
7. Force Majeure
Active Coach shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, strikes, government actions, pandemics, or other emergencies. In such cases, we will work with customers to reschedule or provide alternative arrangements.
8. Privacy and Data Protection
8.1 Personal Information: We collect and use personal information in accordance with applicable privacy laws. Your information is used solely for booking, service delivery, and communication purposes.
8.2 Data Security: We implement appropriate security measures to protect your personal information.
8.3 Marketing Communications: You may opt out of marketing communications at any time by contacting us.
9. Dispute Resolution
9.1 Governing Law: These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
9.2 Jurisdiction: Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Ontario.
9.3 Complaints: We encourage customers to contact us directly to resolve any concerns. Complaints should be submitted in writing within 30 days of service.
10. Modifications to Terms
Active Coach reserves the right to modify these Terms at any time. Updated Terms will be posted on our website with the revision date. Continued use of our services after changes constitutes acceptance of the modified Terms.
